In U.S. v. XL Specialty Insurance Company, the U.S. is seeking to enforce its claim for lost duties resulting from entries allegedly containing false statements indicating that the imported merchandise qualified for duty free treatment under the Agreement on Trade and Civil Aircraft ("ATCA") when the imports allegedly did not qualify for duty free treatment.
