Anti-Dumping Duty Increases for Some

 

The International Trade Administration (ITA), US Department of Commerce, has published a notice indicating a change to the anti-dumping duty rates. The Federal Register notice appearing in the May 2, 2005 publication outlines companies affected by the anti-dumping duty rate increase.

At this time only those companies with the "all others" rate will be impacted.

Effective April 27, 2005, the anti-dumping duty rate for those companies that did not request an administrative review increased from 8.43% to 11.5% for all shipments entered on, or withdrawn from warehouse for consumption on or after this date. Those companies that have undergone an administrative review should not see a change to their rates at this time.

Customs and Border Protection (CBP) representatives have indicated that they will be rejecting affected files and will require them to be re-filed, based on these new instructions. Furthermore, Commerce announced that interested parties may request to participate in the third administrative reviews of the ADD and CVD orders covering softwood lumber products from Canada. Commerce must receive the requests in the proper format no later than the last day of May 2005. Interested parties are advised to consult legal counsel for guidance.
